Hi there! I apologize if you felt as though you were being singled out for this one image; that was not my intention. How I found this image was through the contributions of User:MP123, who had a few months back flooded a lot of images into Wikipedia which shouldn't have been there. They have since discussed it with editors, and undone much of this, and touched the Pat Neshak article. On looking at it, although I disagreed with his method of saying it wasn't fair use (and I hope overall he's getting better about that; he's learning and contributing a lot to the Wikipedia in any case), I did agree with his assessment, so I put it back to fair use disputed.
That being said, I would agree that any portrait photo taken from the Minnesota Twins website is not fair game for Wikipedia; see, where I'm coming from is we have had historical issues with football player articles, where people would put magazine covers of players on articles (saying 'It's a magazine cover'), or official photos (saying 'It's promotional' or 'Wikipedia is non-profit'), and on the football side of the fence, it has generally been agreed that these are not appropriate fair use declarations, because what they are are copyright photos which someone could theoretically take with their own camera and release under GFDL. If you look at say, Brett Favre, or Peyton Manning, neither have photos on them because there are no appropriately free photos to use. I've edited many Green Bay Packers articles, and I sure know that desire to want to have images for players wherever possible. That said...I think an agreement was come to on the football side of things as to what could work...here's an example: Ahman Green, taken by someone in the stands, and uploaded with GFDL.
I am truly sorry if you felt singled out by my disputing this image. I do not, however, have the bandwidth to find all of the images under this criteria and dispute them. However, if you do agree with my core assessement about fair use not being appropriate here, this is something you could certainly do, as I know you know the Twins articles much better than I. I would say that in the general sense, I dispute all such photos used like this - official website photo used in a player's infobox.
(This is an as-I-see-it discussion, though there is some significant agreement about this: please see WP:FAIR) - Invariably, official photos are copyright, and someone could take their own camera and produce a similar portrait image. Now, if that image were about player X's record breaking home run, no other such image exists, and that image is in the section about the record breaking home run, then I would say that could work. For example, see The Tackle. If a significant discussion is made about the weird tattoo a player had, as shown in a Sports Illustrated issue that caused controversy, fair use might be declared in the section about the article to show that image, but not in the player's infobox, which is simply discussing the person.
Again, apologies if we've gotten off on the wrong foot, but yes, in the general case, I disagree with any such photo being used like this. I hope this clears up any misunderstanding. Do you happen to have the link to the page where you found this image? I ask because it has come into question whether or not this image is in public domain, and thus can be used on Wikipedia. Unfortunately, I just checked that, and it's actually cc-by-nc-nd, which we can't use. The license has to allow derivatives and commercial use. I'm changing the tag to reflect the correct license, which will toss it in speedy. You may want to ask the photographer if he'll change the terms for this one. —Chowbok 02:45, 16 November 2006 (UTC)
